Holmes’ court hearing delayed

AURORA | James Homes’ court appearance Thursday has been pushed back after prosecutors said they hadn’t yet received all the information needed to argue whether a package he sent his psychiatrist is privileged.

In an order issued Wednesday, Judge William Sylvester said the issue of privilege regarding Holmes’ communication with his doctor will be addressed at a hearing Aug. 23.

Homes’ defense team didn’t object to the delay.

Holmes is facing dozens of murder and attempted murder charges after police say he opened fire on an Aurora theater last month, killing 12 and wounding 58. He has been in jail since his arrest a short time after the July 20 shootings.
